Believe it or not, there...

Believe it or not, there is an occasion when you can refuse a roadside breath test. That’s when the police don’t have reasonable cause to suspect you have committed a traffic offence, consumed alcohol or been involved in an accident.

However, if they can argue a case for any of these three, you would be very foolish to snub the test. Simply turning down this initial breath analysis is an arrestable offence, and carries a fine of up to ÷£1,000 and four points on your driving licence.

Once back at the station, a positive result or refusing the initial request for a sample means you’ll be required to take two further breath tests – the lower of which will be used as evidence. Turning down this part of the proceedings will land you with a much heftier penalty of up to ÷£5,000 and/or six months in prison, plus disqualification for at least 12 months. In fact, this is the exact same punishment you get if you are caught driving while under the influence!
